1. Agreement to Terms

Welcome to Kelkkan. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and online psychological consultancy services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Kelkkan provides online psychological consultancy services, including but not limited to:

• Individual therapy sessions via video call
• Couple therapy and counseling
• Child therapy services
• Mental health assessments
• Wellness coaching and support
• Fitness and diet consultation

Our Services are provided by licensed and qualified mental health professionals. However, our Services are not intended to replace emergency medical care or in-person psychiatric treatment.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age, or have parental/guardian consent if under 18
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete information during registration

4. User Account

4.1 Account Registration

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms or any applicable laws
• Provide false or misleading information
• Engage in fraudulent or abusive behavior
• Harass therapists or other users

5. Booking and Appointments

5.1 Scheduling

• Appointments can be booked through our website or app
• Confirmation will be sent via email and/or SMS
• You are responsible for ensuring your availability at the scheduled time

5.2 Cancellation Policy

• Cancellations made 24+ hours before the appointment: Full refund
• Cancellations made 12-24 hours before: 50% refund
• Cancellations made less than 12 hours before: No refund
• No-shows: No refund

5.3 Rescheduling

You may reschedule your appointment up to 12 hours before the scheduled time at no additional cost, subject to therapist availability.

6. Payments and Fees

6.1 Pricing

• Session fees are displayed on our website at the time of booking
• All prices are in Indian Rupees (INR) unless otherwise stated
• We reserve the right to modify pricing with prior notice

6.2 Payment Processing

• Payments are processed securely through Razorpay
• We accept credit cards, debit cards, UPI, net banking, and digital wallets
• Payment is required at the time of booking

6.3 Refunds

Refunds, when applicable, will be processed within 5-7 business days to the original payment method. Please refer to our cancellation policy for refund eligibility.

7. User Conduct

When using our Services, you agree NOT to:

• Provide false or misleading information
• Harass, abuse, or threaten therapists or other users
• Record sessions without explicit consent
• Share or distribute content from sessions
• Use the Services for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Impersonate another person or entity

8. Therapist-Client Relationship

8.1 Professional Services

Our therapists are licensed professionals who provide services within their areas of expertise. The therapist-client relationship is established when you begin a session.

8.2 Confidentiality

All sessions are confidential, subject to legal exceptions including:

• Imminent risk of harm to yourself or others
• Suspected abuse of a child, elder, or dependent adult
• Court orders or legal requirements

8.3 Limitations

Our Services:

• Are not a substitute for in-person psychiatric care when needed
• Do not include prescription of medications
• Are not suitable for severe mental health emergencies

9. Intellectual Property

All content on our platform, including text, graphics, logos, and software, is the property of Kelkkan or its licensors and is protected by intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code

10. Limitation of Liability

To the maximum extent permitted by law:

• Our Services are provided "as is" without warranties of any kind
• We do not guarantee specific outcomes from therapy
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the Services

11. Indemnification

You agree to indemnify and hold Kelkkan, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you provide through the Services

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date
• Sending an email notification for significant changes

Continued use of the Services after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Kerala, India.
